Welcome to HourSync!
These Terms of Service ("Terms") govern your use of the HourSync website at https://hoursync.com ("Website") and the embeddable widget service provided by HourSync (the "Service"). By using our Website and Service, you agree to these Terms.
1. Description of HourSync
HourSync is an embeddable widget service that helps small businesses display accurate, up-to-date opening hours on their websites. Our Service automatically syncs with Google Business Profile and provides real-time open/closed status, including public holiday awareness. The Service includes customizable appearance options, domain allowlisting for security, and a dashboard for managing widgets.
2. Account Registration and Eligibility
To use our Service, you must:
- Be at least 18 years old or have parental consent
- Create an account using Google OAuth authentication
- Provide accurate and complete information
- Maintain the security of your account credentials
- Be responsible for all activities that occur under your account
3. Subscription and Payment
3.1 Subscription Plans
HourSync offers subscription-based plans, including self-serve tiers and concierge onboarding options. Subscription fees are charged in advance and automatically renew unless cancelled. You agree to pay all fees associated with your selected plan.
3.2 Payment Processing
All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method for the subscription fees. You are responsible for providing valid payment information.
3.3 Refunds
We offer refunds in accordance with our refund policy. Refund requests must be submitted within 7 days of purchase. Refunds are processed at our discretion and may take 5-10 business days to appear in your account.
3.4 Cancellation
You may cancel your subscription at any time through your dashboard. Cancellation will take effect at the end of your current billing period. You will continue to have access to the Service until the end of your paid period.
4. Service Usage and Restrictions
4.1 Permitted Use
You may use the Service to:
- Display opening hours on websites you own or have authorization to modify
- Embed widgets on domains that you have added to your allowlist
- Customize widget appearance and settings
- Sync opening hours with Google Business Profile
4.2 Prohibited Use
You may not:
- Use the Service for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Reverse engineer, decompile, or disassemble the Service
- Use the Service to display content that is illegal, harmful, or violates third-party rights
- Remove, alter, or obscure any proprietary notices or labels
- Use the Service in a manner that could damage, disable, or impair our servers or networks
- Attempt to bypass security measures, rate limits, or domain restrictions
5. Google Business Profile Integration
By connecting your Google Business Profile, you grant HourSync permission to:
- Access your Google Business Profile information
- Read and sync opening hours data
- Update opening hours information (if you enable push sync)
You are responsible for maintaining the accuracy of your Google Business Profile information. HourSync is not responsible for discrepancies between your Google Business Profile and displayed hours.
6. Intellectual Property
6.1 Our Rights
The Service, including all software, code, designs, and content, is owned by HourSync and protected by intellectual property laws. You do not acquire any ownership rights by using the Service.
6.2 Your Rights
You retain ownership of your business information and content. By using the Service, you grant HourSync a license to use, store, and display your content solely for the purpose of providing the Service.
7. Widget Embedding and Domain Security
7.1 Domain Allowlisting
You are responsible for adding authorized domains to your widget's allowlist. Widgets will only function on domains that have been explicitly authorized. You must not attempt to use widgets on unauthorized domains.
7.2 Embedding
You may embed widgets on authorized domains using the provided embed code. You are responsible for ensuring that the embed code is correctly implemented and that your website complies with applicable laws and regulations.
8. Service Availability and Modifications
We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. We reserve the right to:
- Modify, suspend, or discontinue the Service at any time
- Perform maintenance that may temporarily interrupt service
- Update features and functionality
We will make reasonable efforts to notify you of significant service interruptions or changes.
9. Data and Privacy
We collect and store user data, including name, email, payment information, and widget configuration data, as necessary to provide our services. For details on how we handle your data, please refer to our Privacy Policy at https://hoursync.com/privacy-policy.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HourSync SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
11. Indemnification
You agree to indemnify and hold harmless HourSync and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HourSync operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
